1. Acceptance of Terms
By accessing or using whatayarn at https://whatayarn.com (the “Service”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree, please do not use the Service.
2. About whatayarn
whatayarn lets podcasters and creators share a link where their audience can record or upload short voice messages. Messages arrive in the creator’s inbox, where they can listen to them, download them, and manage them.
These Terms apply to both groups: creators, who hold an account and run a channel, and senders, who leave voice messages on a creator’s page.
3. Your Account
- You must provide accurate information when creating an account and keep your sign-in details secure.
- You are responsible for all activity that happens under your account.
- You can delete your account at any time from your account settings. Deleting your account permanently removes your channels and the messages in them.
4. Plans, Billing & Cancellation
- whatayarn offers a free plan with usage limits and a paid Creator plan, billed monthly or yearly through Stripe.
- You can cancel your subscription at any time from your billing settings. Your plan stays active until the end of the period you have already paid for, and you will not be charged again.
- Except where the law requires otherwise (including the Australian Consumer Law), payments are non-refundable.
- We may change plan pricing from time to time. If we do, we will give you reasonable notice, and the new price applies from your next billing period.
5. Voice Messages
If you send a message:
- You keep ownership of the recordings you send.
- By sending a message, you grant whatayarn a worldwide, royalty-free licence to host, store, and play your recording as needed to operate the Service.
- You also give the channel owner permission to listen to, download, and use your message in their own content, for example by playing it in a podcast episode.
- You confirm that your message does not infringe anyone else’s rights and does not contain unlawful, hateful, or defamatory material.
If you run a channel:
- You are responsible for how you use the messages you receive, including any use outside the Service.
- You must not use sender contact details for anything beyond responding to their message, unless they have agreed to more.
We may introduce optional processing of recordings in the future, such as automatic transcription, to make messages easier to read and search. Any such processing will be covered by our Privacy Policy.
6. Acceptable Use
You agree not to:
- Violate any applicable law;
- Upload malicious code or attempt to gain unauthorised access to our systems;
- Use the Service to harass, abuse, or harm others;
- Send spam or unsolicited promotional messages through a creator’s channel;
- Reverse-engineer or decompile any part of the Service.
We may remove content or suspend accounts that breach these rules.
7. Privacy
Our Privacy Policy explains what data we collect from creators, senders, and visitors, how we use it, and the choices you have.
8. Third-Party Services
Payments are processed by Stripe. We do not store your full payment card details on our servers. The Service is built on third-party infrastructure providers, listed in our Privacy Policy, and use of any third-party service is subject to its own terms.
9. Service Availability & Changes
We are always improving whatayarn, which means we may add, change, or remove features over time. The Service is provided on an “as available” basis and we do not guarantee uninterrupted access.
10. Disclaimer & Limitation of Liability
The Service is provided “as is” without warranties of any kind. To the maximum extent permitted by law, whatayarn and its owners are not liable for indirect, incidental, or consequential damages arising out of your use of the Service.
Nothing in these Terms excludes, restricts, or modifies any consumer guarantees or rights you have under the Australian Consumer Law or other laws that cannot be excluded.
11. Termination
We may suspend or terminate accounts that breach these Terms. You can stop using the Service and delete your account at any time.
12. Governing Law
These Terms are governed by the laws of New South Wales, Australia. You consent to the exclusive jurisdiction of the courts located there.
13. Changes to the Terms
We may update these Terms from time to time. Material changes will be announced by email to the address on your account and posted on this page with a new “Last updated” date. Continued use after the effective date constitutes acceptance of the revised Terms.
