1. Acceptance of Terms
By accessing or using whatayarn at https://whatayarn.com (opens in a new tab) (the “Service”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree, please do not use the Service.
2. About whatayarn
whatayarn lets podcasters and creators share a link where their audience can record or upload short voice messages. Messages arrive in the creator’s inbox, where they can listen to them, download them, and manage them.
These Terms apply to both groups: creators, who hold an account and run a channel, and senders, who leave voice messages on a creator’s page.
Public channel pages include a small whatayarn attribution. They may also include a restrained promotional link to a related product operated by us, such as reroute.bio (opens in a new tab). This placement forms part of both Free and Creator plans unless the applicable plan description expressly says otherwise. It is placed by whatayarn and does not mean that the channel owner endorses the promoted product.
3. Your Account
- You must provide accurate information when creating an account and keep your sign-in details secure.
- You are responsible for all activity that happens under your account.
- You can delete your account at any time from your account settings. Deleting your account permanently removes your channels and the messages in them.
4. Plans, Billing & Cancellation
- whatayarn offers a free plan with usage limits and a paid Creator plan, billed monthly or yearly through Stripe.
- You can cancel your subscription at any time from your billing settings. Your plan stays active until the end of the period you have already paid for, and you will not be charged again.
- If you delete your account while you have a paid subscription, your subscription and access end immediately. You will not be charged again, but payments already made will not be refunded except where the law requires otherwise.
- Except where the law requires otherwise (including the Australian Consumer Law), payments are non-refundable.
- We may change plan pricing from time to time. If we do, we will give you reasonable notice, and the new price applies from your next billing period.
5. Voice Messages
If you send a message:
- You keep ownership of the recordings you send.
- By sending a message, you grant whatayarn a worldwide, royalty-free licence to host, store, and play your recording as needed to operate the Service.
- You also give the channel owner permission to listen to, download, and use your message in their own content, for example by playing it in a podcast episode.
- You confirm that your message does not infringe anyone else’s rights and does not contain unlawful, hateful, or defamatory material.
If you run a channel:
- You are responsible for how you use the messages and sender details you receive, including any use outside the Service, and for obtaining any consents your own laws require from the people who message you. You will cover us against any claims that arise from that use or from your channel content.
- You must not use sender contact details for anything beyond responding to their message, unless they have agreed to more.
We may introduce optional processing of recordings in the future, such as automatic transcription, to make messages easier to read and search. Any such processing will be covered by our Privacy Policy.
6. Acceptable Use
You agree not to:
- Violate any applicable law;
- Upload malicious code or attempt to gain unauthorised access to our systems;
- Use the Service to harass, abuse, or harm others;
- Send spam or unsolicited promotional messages through a creator’s channel;
- Reverse-engineer or decompile any part of the Service.
We may remove content or suspend accounts that breach these rules.
7. Privacy
Our Privacy Policy explains what data we collect from creators, senders, and visitors, how we use it, and the choices you have.
8. Data Processing Terms
These terms apply automatically whenever you run a channel and receive messages from other people. They are our data processing agreement.
- Roles. For the recordings and form answers your senders leave (“sender data”), you are the controller and whatayarn is your processor. For our own account, billing and analytics data, we are the controller, as described in the Privacy Policy.
- Instructions. We process sender data only to provide the Service as described in these Terms and the Privacy Policy, and on the instructions you give through the product, such as deleting a message or turning source details off.
- Confidentiality and security. We keep sender data confidential, limit access to what is needed to run the Service, and apply the security measures described in the Privacy Policy.
- Sub-processors. We use the providers listed in the Privacy Policy. We will update that list before adding or replacing a provider that handles sender data. If you object to a change, you can delete your account.
- International transfers. whatayarn operates from Australia, and our providers store data in Australia and the United States. Where UK or EU data protection law applies to you, transfers rely on the UK International Data Transfer Addendum and the EU Standard Contractual Clauses (controller to processor), which are incorporated into these Terms by reference.
- Assistance. We will help you respond to sender requests to access or delete their data, and to regulator enquiries, to the extent we reasonably can and in writing by email. The inbox lets you handle most requests yourself.
- Breaches. If we become aware of a personal data breach affecting sender data, we will tell you without undue delay.
- Deletion. Sender data is deleted when you delete the message or your account, as described in the Privacy Policy, except for copies in routine backups, which expire automatically.
- Audits. We will provide, in writing, the information reasonably needed to show we comply with these terms and, where that is not enough, answer a written audit questionnaire once a year, at your cost and on 30 days’ notice. We do not attend meetings or calls or host inspections unless a data protection regulator requires it.
9. Third-Party Services
Payments are processed by Stripe. We do not store your full payment card details on our servers. The Service is built on third-party infrastructure providers, listed in our Privacy Policy, and use of any third-party service is subject to its own terms.
10. Service Availability & Changes
whatayarn is a small independent service that changes often. That means:
- We may add, change, limit or remove features, plans and free-tier usage limits at any time.
- We may suspend or discontinue the Service, in whole or in part. If we discontinue the Service or a paid plan, we will try to give at least 30 days’ notice by email and a chance to download your messages, and we will refund any prepaid period we can no longer deliver.
- The Service is provided on an “as available” basis, without uptime, support or backup commitments. Download any recordings you want to keep.
11. Disclaimer & Limitation of Liability
The Service is provided “as is” without warranties of any kind. To the maximum extent permitted by law, whatayarn and its owners are not liable for indirect, incidental, or consequential damages arising out of your use of the Service.
To the extent permitted by law, our total liability to you for all claims arising out of or relating to the Service in any 12-month period is limited to the amount you paid us in that period, or AUD 50 if you paid nothing.
Nothing in these Terms excludes, restricts, or modifies any consumer guarantees or rights you have under the Australian Consumer Law or other laws that cannot be excluded.
12. Termination
We may suspend or terminate accounts that breach these Terms. You can stop using the Service and delete your account at any time.
13. Governing Law
These Terms are governed by the laws of New South Wales, Australia. You consent to the exclusive jurisdiction of the courts located there.
14. Assignment
We may transfer these Terms, and the data held under them, to a successor if whatayarn is sold, merged or restructured. The Privacy Policy continues to apply to your data after any transfer. You may not transfer your account or these Terms to anyone else without our agreement.
15. Changes to the Terms
We may update these Terms from time to time. If we make material changes, we will notify you, for example by email to the address on your account or a notice in the app, and post the update here with a new “Last updated” date. Continued use after the effective date constitutes acceptance of the revised Terms.
